Toshi Reviews & UGC – Terms & Conditions

These Terms & Conditions apply to the use, submission, and publication of customer reviews, photos, and other user-generated content ("UGC") submitted to or collected by "Toshi Australia Pty Ltd ACN 100 974 669 ("Toshi", "we", "our" or "us")."

 via our website or third-party platforms.

By submitting a review, photo, or other content to Toshi, you agree to the following terms:

1. Submission Guidelines

  • You may only submit content that is honest, accurate, and based on your actual experience with a Toshi product or service.
  • By submitting content, you confirm that:
    • You are the original creator and owner of the content.
    • You are over 18 years old or have permission from a parent or guardian.
    • Your content does not infringe on any third-party rights, including copyright, trademarks, or privacy.

2. Content featuring children

For content featuring children:

·       If your review includes photos of children wearing our products, you confirm you are the parent or legal guardian of the child, or have obtained permission from the parent/guardian

·       Photos should focus on the product rather than identifying features of children

·       By submitting photos of children, you grant permission for commercial use across our marketing channels

3. Moderation & Authenticity

  • Toshi uses Fera.ai to collect and display reviews and UGC.
  • Reviews may be reviewed for inappropriate or offensive content, but we do not modify the content of reviews.
  • We aim to publish all authentic, constructive feedback — both positive and negative — unless it contains:
    • Hate speech, personal attacks, or discriminatory language
    • Profanity or explicit content
    • Promotional links, spam, or irrelevant information
    • False, misleading, or defamatory claims

4. Use of Your Content

  • By submitting content, you grant Toshi a royalty-free, worldwide, perpetual, non-exclusive license to use, reproduce, edit, and display your content across our website, email, social media, advertising, or other marketing materials.
  • This may include your first name, initials, location, and product name (but not your full contact details or order information).
  • We may resize, crop, or apply design formatting to submitted photos for consistency but will not materially alter your content’s message or intent.

5. Review Incentives

  • Toshi may offer loyalty points, discounts, or other rewards as a thank-you for leaving a review.
  • Incentivised reviews are only accepted after a purchase, and reviewers are not required to leave a positive review to receive the incentive.
  • We clearly mark incentivised reviews where applicable (e.g. “Verified Review – Rewarded”).

6. Right to Remove or Refuse Content

  • We reserve the right to:
    • Refuse to publish any review or content that breaches these terms
    • Remove previously published content if it becomes inappropriate or legally problematic
    • Suspend users who repeatedly submit abusive or fraudulent content

7. Privacy

  • Personal information collected in connection with your review or content is handled in accordance with our [Privacy Policy].
  • Your data will only be used in ways that are consistent with Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth).

8. Feedback & Complaints

9. Changes to These Terms

We may update these Terms from time to time. The most current version will always be available on our website.

10. Governing Law & Jurisdiction 

These Terms are governed by the laws of Victoria, Australia. Any disputes arising from these Terms or your use of our review system will be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
